The tenant is in revision assailing the order dated 23.8.2009 passed by the learned Rent Controller, Yamuna Nagar whereby he was ordered to be evicted on the ground of personal necessity of the specified landlord in his application filed under Section 13-A of the Haryana Urban (Control of Rent and Eviction) Act, 1973.
At the time of hearing, it is stated that the present revision has become infructuous in view of the fact that the tenant has already handed over the peaceful and vacant possession of the shop in question to the landlord.
Learned counsel for the respondent does not dispute the
aforesaid factual position.
In view of the aforesaid agreed stand, present eviction petition is dismissed as infructuous.
