Angerj Kaur and Ors. Vs State of Punjab and Ors.

Learned counsel for the petitioners has submitted that the compensation with regard to the land measuring 57 bigha and 2- 2/3 biswas was awarded by the Land Acquisition Collector and enhanced by the Reference Court. Sukhdev Singh and thereafter legal representatives of Sukhdev Singh had claimed their share in the land i.e. ½ share and later on legal representatives of Kaur Singh also joined in the execution.

As such, this petition is disposed of with the direction to the trial court to calculate the compensation as per award dated 25.2.1985 and 21.11.1988 and then disburse the same to the right holders.

This petition is disposed of without serving notice to the respondents with a view to impart complete justice to the parties and to save the huge expenses, which may be incurred by the respondents as also in order to avoid unnecessary delay in adjudication of the matter. Still, if dissatisfied, the respondents may move to this court for recalling this order.
