Tenant is in revision assailing the order dated 9.8.2012 passed by the learned Appellate Authority, Chandigarh whereby mesne profits to the tune of Rs.40000/- per month for the demised premises from the date of order of ejectment i.e 16.11.2011 passed by the learned Rent Controller, have been allowed.
The grievance of the petitioner-tenant was regarding rate of mesne profits determined in view of no lease deed produced on record by the landlady.
At the time of hearing today, learned counsel for the petitionertenant points out that in the meanwhile, the appeal of the tenant against the eviction order passed by the learned Rent Controller has since been accepted vide order dated 18.7.2013 passed by the learned Appellate Authority, Chandigarh. He, thus, submits that the present revision has been rendered infructuous.
Learned counsel for the respondent does not dispute the aforesaid fact.
Dismissed as infructuous.
