At this stage, it may be noticed that the petitioner herein namely Jatinder Sharma, who is wife of tenant-respondent No.2 Subhash Sharma moved an application under Order 1 Rule 10 CPC for impleading her as respondent in the present ejectment petition alleging that an agreement to sell dated 17.6.2004 was executed between the parties whereby an amount of Rs.3,00,000/- were paid by her for the purchase of the aforesaid premises, as earnest money and she has also filed a suit for specific performance on the basis of the aforesaid agreement executed between the parties and thus, she has claimed title over the suit property being a prospective vendor. The aforesaid application was dismissed by the trial Court vide order dated 24.4.2013 observing that the applicantpetitioner is not claiming herself to be a tenant in the demised premises and is in fact claiming title over the suit property for which her remedy lies elsewhere. CR No.3229 of 2013 has been filed by the petitioner-Jatinder Sharma against the aforesaid order dated 24.4.2013 whereby her prayer for impleadment has been rejected.
