The petitioner has sought to set aside the order dated 25.1.2013 (Annexure P/2) passed by the trial court.
The property in dispute consists of four rooms, varandah bathroom, kitchen, store, pooja room and A-Class building situated in the posh colony in the heart of Hoshiarpur City, therefore, the court after taking into consideration the stock of the situation has determined the mesne profits @ Rs.5,000/- per month, though the respondent was demanding Rs.15,000/- per month. There is no rent deed executed between the parties, as such the trial court while examining the matter with regard to mesne profits from the facts and situation and the alleged circumstances prevailing over the case, cannot be said to have committed any illegality.
No grounds to interfere.
Dismissed.
