The petitioner has sought to set aside the order dated 19.2.2013 (Annexure P/5) passed by the trial court.
The respondent being the owner of the property is alleged to have executed the gift deed which came in adjudication. Learned counsel for the petitioner submits that though the suit filed by the respondent was dismissed yet the said judgment is still in appeal, therefore, so long as the judgment does not attain finality the respondent cannot be termed as licencee. This suit for injunction in the other terms is the suit for possession, as such, the plaintiff is bound to pay the court fee.
Dismissed.
