Reply by way of short affidavit of B. Purushartha, Director, Department of Technical Education and Industrial Training, Punjab, Chandigarh, dated 4.3.2013 filed in court, is taken on record.

The present contempt petition has been filed with a grievance that the order passed by this court on 2.12.2011 in CWP No. 22434 of 2011, whereby the respondents therein were directed to take a final decision on the legal notice got served by the petitioner, has not been complied with.

As is evident from the pleadings in the present petition, the grievance of the petitioner was that earlier his name was appearing at Sr. No. 362 in the seniority list, however, in the seniority list circulated on 24.9.2010, his name was not there.

Along with reply, an order dated 11.12.2012 has been annexed. It has been stated that in terms of the directions issued by this court on 2.12.2011, the legal notice got issued by the petitioner, has been decided. It has been stated in the affidavit that the name of the petitioner has been mentioned at Sr. No. 362 of the seniority list of the Non-Engineering trade Instructors issued on 24.9.2010.

The order passed by this court has been complied with. For the delay in compliance to the order, unconditional apology has been tendered. The same is accepted. The proceedings initiated against the respondents are dropped. However, it is made clear that in case the petitioner is aggrieved of the order dated 11.12.2012, he may avail of his appropriate remedy in accordance with law.
