The petitioner through instant contempt petition has expressed grievance that the direction dated September 6, 2011 for considering the claim of the petitioner for providing employment under Rehabilitation and Re-settlement Scheme dated November 8, 1993 has not been considered by passing a speaking order.

In the reply filed by Chief Engineer, Ranjit Sagar Dam Project, Shahpurkandi Township, it has been informed that the claim of the petitioner has been considered as follows:-

“That in compliance to the order dated 30.8.2013, the claim of the petitioner namely, Sh.Kuldeep Singh son of Sh. Karnail Singh from the family of Kesari Devi Daughter of Jagtu was considered on the basis of land verification report submitted by the Collector, Land Acquisition, Thein Dam Project, Basholi which is annexed as annexure R-1 and it has been found that land of Mst.Kesari daughter of Jagtu was acquired and the petitioner fulfill the condition laid down under the Rehabilitation and Resettlement Policy dated 18.11.1993 for employment but Sh.Romesh Singh son of Prem Singh from the family of Kesari Devi daughter of Jagtu who is cousin brother of the petitioner has already been provided employment as Class IV employee on the basis of land verification report submitted by the Collector, Land Acquisition, Thein Dam Project, Basholi from the same khata which is annexed as Annexure R-2. Hence, the claim of the petitioner is rightly rejected as only one member per family is to be provided employment under the Rehabilitation and Resettlement Policy.”

Counsel for the petitioner, faced with this situation has submitted that the claim of the petitioner vis-à-vis his brother Ramesh Singh has not been fairly considered and that the petitioner has got a preferential right to be considered and appointed.

Without expression of any opinion on the rival claim of the petitioner with his family members, this petition is disposed of as having been rendered infructuous, as order passed by this Court having been complied with, without prejudice to the rights of the petitioner to avail other legal remedies available to him for claiming employment under the said scheme by challenging the above said decision.
