The defendants/appellants are in second appeal before this Court. Briefly noticed, the plaintiff filed a suit for rendition of accounts and for recovery of money against the defendants by stating that defendant No.1 is a partnership firm in which defendants No.2 to 6 are the partners and such firm is running the business of Commission Agency in Anaj Mandi, Ratia, District Fatehabad. The plaintiff stated himself to be an agriculturist and pleaded that he had been selling his crops to the defendantfirm, who had been maintaining an account in his name. The plaintiff pleaded that he had sold the wheat and paddy crops to the defendants from 1993 to 2000 and details in this regard were furnished in para No.4 of the plaint. It was also pleaded that the defendants had made payments to the plaintiff with regard to the agricultural produce sold by him on time to time and that too upon obtaining his signatures in the bahi. The plaintiff had stopped dealing with the defendants since 2001 as he was apprehending that proper accounts were not being maintained. Accordingly, he had called upon the defendants to settle the accounts but the matter has been delayed on one pretext or the other. The defendants having refused to settle the accounts. Accordingly, the suit has been instituted. The defendant contested the suit in terms of filing the joint written statement. It was stated that whatever crops have been sold by the plaintiff to them, had been accounted for in the books of the firm. It was pleaded that an amount of ` 1,55,300/was outstanding against the plaintiff after adjusting the entire sale proceeds of the agricultural produce brought by the plaintiff to their shop and it was the plaintiff, who had failed to clear such account.
