The plaintiff-appellant had expired in the month of May, 2011, which was noticed in the order dated 23.08.2011. Thereafter, the appeal has been repeatedly adjourned but no application has been filed to bring the L.Rs. on record. Accordingly, there is no option but to dismiss the appeal having been abated, however, liberty is granted to the L.Rs. of the deceasedappellant to file an application for revival of the appeal, if they so wish.
Accordingly, the appeal is dismissed with the liberty aforesaid.
