Order dated 05.01.2012 has not been complied with.

A perusal of the file shows that notice of the application for condonation of delay was issued on 07.04.2010 for 13.05.2010. On the said date, office reported that the address is not complete and the counsel took time and accordingly, the case was adjourned to 03.08.2010. Even on 03.08.2010 another request was made to comply with the order. On 26.10.2010, one more opportunity was prayed for and granted. Thereafter, on 15.02.2011, notice was given through dasti process for 06.04.2011. On 06.04.2011, the order shows that the counsel had failed to collect the dasti process. On 05.09.2011, respondent No.1 still remained un-served and fresh notice was issued for 05.01.2012. On 05.01.2012, notice issued to respondent No.1 was received back with the report that address was not complete and accordingly, counsel for the appellants was directed to file correct address within 10 days. Office report shows that correct address has not been furnished.

Thus, it would be clear that the appellants are not interested in pursuing the present appeal. The same is, accordingly, dismissed for want of prosecution.
