The only point urged by counsel for the petitioner is that as a petition filed under Section 72-E of the Punjab Town Improvement Act, 1922, against cancellation of the earlier auction, is pending adjudication before the Principal Secretary, Department of Local Government, Punjab, the Improvement Trust, Patiala, should be restrained from carrying out a fresh auction. Counsel for the petitioner prays, that in the alternative, it may be ordered that during pendency of the petition filed under Section 72-E of the Punjab Town Improvement Act, 1922, the auction to be conducted by the Improvement Trust, Patiala, may not be confirmed.
We have heard counsel for the petitioner, perused the pleadings and as the petitioner has already filed a similar application, Annexure P-6, before the Principal Secretary, Department of Local Government,
