The petitioner-Society is running a College for B.Ed.Course by the name of B.S.College of Education in Narnaul, District Mohindergarh. The petitioner-College was granted approval for Session 2007-08 for starting B.Ed.Course with intake of 100 seats and was also granted affiliation by Maharshi Dayanand University, Rohtak on 14.9.2007. The petitioner-College made an application for increasing its intake capacity and deposited a fee of `41,000/- by way of demand draft for processing the requisite documents. The application filed by the petitioner-College was rejected on the ground that such an application can only be submitted as per the new regulation after expiry of three years of the start of the College/ Institution. The petitioner-College accordingly approached this court through the present writ petition pleading that they had obtained a

loan of `80.00 lacs for functioning of the College and that the permission to increase the intake was wrongly declined.
The writ petition has remained pending for all these years. Obviously, by now the infirmity, which has been pointed out by the respondent, would be no more there for the petitioner-College to seek an enhancement in intake capacity of the College. The petitioner-Institution shall be at liberty to file a fresh application seeking enhancement of the intake, if it so desires. If any such application is filed, the same shall be considered by the respondent in accordance with law. The writ petition otherwise is rendered infructuous and is dismissed as such.
