Sunny Vs Union of India and Ors.

The petitioner has filed the present petition under Articles 226/227 of the Constitution of India seeking a writ of certiorari/mandamus for quashing the action of the respondents in issuance of no objection certificate for installing a petrol pump at village Chang which according to the petitioner is in violation of the guidelines for access, location and layout of roadside fuel stations and service stations. A further prayer has also been made for directions to the respondents not to instal any petrol pump at the curve of State Highway.

Learned counsel for the petitioner states that a representation (Annexure P-3) for the aforesaid purpose has been submitted by the petitioner. However, no decision has been taken thereon so far. He states that at this stage, the petitioner shall be satisfied in case a time-bound direction is issued to respondent No.2

After hearing learned counsel for the petitioner, perusing the petition and without expressing any opinion on the merits of the case, the present petition is disposed of by directing respondent No.2 to take a decision on the representation (Annexure P-3) filed by the petitioner by passing a speaking order in accordance with law within a period of two months from the date of receipt of certified copy of
