The petitioner is a public limited company against whom a petition had been filed by respondent No.2 under Section 22(c) of the Legal Service Authority Act, 1987 (wrongly mentioned as Public Utility Services Act in the petition) before Permanent Lok Adalat (Public Utility Services) [in short PLA(PUC)] – respondent No.1 bearing Application No.913 of 2011, titled as “Khalid son of Masoon Ali Vs. Rajesh Motors (Rajasthan) Private Ltd. and another”. In the said petition, respondent No.2 had claimed that JCB machine had been purchased by him on 18.10.2010 through respondent No.3, being a dealer of the petitioner for which one year

warranty was provided. On notice having been issued by PLA(PUC), the petitioner has approached this Court by way of present writ petition challenging the issuance of notice alleging that PLA(PUC) has no jurisdiction to issue the same.

Respondent No.2, who has filed the petition before the PLA (PUC), has produced a photocopy of the order dated 28.10.2011, wherein, on the statement of respondent No.2 herein, Application No.913 of 2011 was dismissed as withdrawn. Photocopy of the order is taken on record.

In view of the order dated 28.10.2011, present writ petition has been rendered infructuous and the same is disposed of as such.
