The petitioners pray for issuance of a writ of certiorari for quashing notice dated 17.5.2010 (Annexure P-21), calling upon the petitioner to pay penalty, in accordance with provisions of Chandigarh Estate Rules, 2007.
We have heard counsel for the parties and are satisfied that as a mere show-cause-notice has been issued, demanding charges for misuse of premises, the petitioners would be required to file a reply to the show-cause-notice taking the pleas raised herein. The petitioners would also be at liberty to point to the authority that vires of the said rules are under challenge before this Court. The petitioners may also bring to the notice of the respondents that they have shifted from the premises in August, 2011. We, therefore, dispose of the writ petition, as premature, with liberty to the petitioners to file an appropriate reply to the show-cause-notice.
