This writ petition has been filed seeking issuance of directions to the respondents to restrain respondent No.3 from setting up rice sheller at Village Chimna, Tehsil Jagraon, District Ludhiana.

It is grievance of the petitioners that to set up above rice sheller, a 'No Objection Certificate' has been issued by respondent No.2 which is contrary to Notifications dated 11.9.2006 and 19.12.2011, Annexures P-1 and P-2 respectively. It is stated that as per above instructions dated 11.9.2006, no rice sheller can be constructed within 500 meters of village lal dora (phirni), residential area, educational institution etc. but now as per Instructions dated 19.12.2011 (Annexure P-2) the area of distance has been reduced to 300 meters. Counsel for the petitioners states that distance of the rice sheller from the school is only 230 meters and from school play ground, it is only 170 meters.

Be that as it may, during arguments, it is transpired that aggrieved petitioners have submitted their representations to respondent No.2 on 6.7.2012 and 13.7.2012 which have not yet been decided.

Under the circumstances, we dispose of this writ petition by issuing direction to respondent No.2 to decide representations filed by the petitioners within one month from the receipt of copy of this order.
