The petitioner, who belongs to reserved category of the Scheduled Castes (M&B) applied for the post of Assistant Librarian in response to a public notice issued by the School Education Department, State of Punjab for recruitment of 7654 posts in the teaching and non teaching cadre. It is contended that 316 posts were earmarked for appointment to the posts of Assistant Librarian. It is further contended that the petitioner was eligible in terms of having possessed the requisite qualification for such post and in the merit that was determined, the petitioner was assigned 43.156 marks and as such, her name appeared at Sr. No.86 in the order of merit. In terms of the public notice (Annexure P-3), the first counselling for the post of Assistant Librarian was held on 6^th & 7^th May, 2010. However, candidates upto merit position No.35 belonging to the reserved category of the Scheduled Castes (M&B) were called and as such, the petitioner was not eligible to participate in such counselling. Thereafter, the second counselling was held in the month of July, 2011 and for which a

public notice (Annexure P-4) had been issued. However, on account of being medically indisposed the petitioner could not attend the second process of counselling. It is contended that in pursuance to the second process of counselling, candidates lower in merit to the petitioner have secured appointment. As such, the limited prayer in the present petition is for an extra chance for consideration being afforded to the petitioner in the light of the fact that posts of Assistant Librarian belonging to the Reserved Category to which the petitioner belongs, are still lying vacant. Learned counsel for the petitioner further submits that even a legal notice dated 29.07.2011 (Annexure P-6) as regards her claim already stands served upon the respondent/authorities.

Without making any observations as regards the merit of the claim raised by the petitioner in the light of the fact that candidates lower in merit have been selected and appointed and coupled with the fact that the petitioner could not attend the second process of counselling on account of compelling circumstances, I deem it appropriate to dispose of the present petition with directions to the respondent/authorities to decide the legal notice dated 29.07.2011 (Annexure P-6) within a period of three months from the date of receipt of certified copy of this order.
