The petitioner, in this writ petition filed under Articles 226 and 227 of the Constitution of India, prays for issuance of a writ in the nature of certiorari quashing auction notice whereby the auction has been scheduled for 24.07.2012 for lifting of garbage/residue from New Anaj Mandi Shahabad (M) and all the mandis under Market Committee Ismailabad, District Kurukshetra.
Learned counsel for the petitioner submitted that though the earlier auction notice (Annexure P-2) was issued for the period from 01.08.2011 to 31.07.2012, in pursuance to which the petitioner was allowed to lift garbage from mandies under the Market Committee, Ismailabad on 02.11.2011. According to the learned counsel, the period of one year had to

be counted from the said date.
Learned counsel further submitted that the respondents have now issued fresh auction notice (Annexure P-5) inviting tenders for contract period from 01.07.2012 to 30.06.2013 when the contract in favour of the petitioner is still subsisting. It was urged that a representation (Annexure P- 6) had been addressed to respondents no. 3 and 4 on 20.07.2012 but no decision thereon has been taken.
After hearing learned counsel for the petitioner, perusing the record and without expressing any opinion on the merits of the case, this petition is disposed of at this stage by directing respondent no. 3 to take a decision on representation (Annexure P-6) submitted by the petitioner within one week from the date of receipt of certified copy of this order by passing a speaking order.
