The petitioners are employees of Delhi Financial Corporation, posted in Chandigarh and are working in connection with the affairs of U.T. Administration. The petitioners did not apply in response to the Self Financing Housing Scheme, 2008 floated by Chandigarh Housing Board as they were ineligible.

Some other similarly placed employees of Delhi Financial Corporation who had applied in response to the above stated Scheme and whose applications were rejected on the plea of

eligibility, approached this Court in Civil Writ Petition Nos.3663 and 4556 of 2008. A learned Single Judge of this Court vide order dated 26.2.2010 decided bunch of writ petitions including the above mentioned writ petitions holding the employees of Delhi Financial Corporation are eligible under the 2008 special scheme.

Since the petitioners did not apply in response to the above stated scheme, no direction for consideration of their applications under the said Scheme can be issued. The writ petition is accordingly disposed of with a direction to the respondent that as and when a similar scheme is floated in future, the petitioners or for that matter, other employees of the Delhi Financial Corporation be treated eligible if the eligibility conditions remain the same.
