The petitioners have now been granted admission in the
B.Ed. Course on the fee earlier deposited by them in the year 2009. It is unfortunate to notice that the career of these three students had retarded for almost three years. The submission made by counsel

appearing for the College that a revised list was submitted on 23.10.2009, containing the names of these three students in place of three earlier students, who had left the College, is strongly denied by counsel appearing for the University, who says that no such list was received. Counsel for the University further points out that in fact this College was fined to the tune of `1,50,000/- on account of such type of activities. Apparently, it seems that the College is resorting to some activities, which are not desirable. The students are apparently being admitted after the last date. The fee may have been fixed by the Government but the Government can not leave every responsibility on such Colleges and will have to have effective control over such Institutions, even if they are privately managed and not receiving any aid from the Government. After all, they have received the affiliation from the University and recognition from the State. The State must look into the affairs of this College and ensure that no undesirable activities are carried out by the College of this nature in future.
Presently, counsel for the petitioners has felt satisfied and this petition is rendered infructuous and is disposed of as such. The petitioners, however, still would be at liberty to seek damages from the College on account of their delay in completing the course and study in the manner as disclosed. The record which was kept with the State counsel, is returned to the counsel appearing for the College.
