Application is accompanied by an affidavit. Sufficient reasons have been given to say that non appearance on the date fixed was not intentional.

In view above, the application is allowed, order dated 13.8.2012 stands recalled and CRWP No.1437 of 2012 is restored to its original number. On request made the same is taken up for hearing today itself.

By filing this petition, the petitioner has prayed for quashing of order dated 18.7.2012 vide which his request for grant of parole for agricultural operations was declined by the competent authority. There is

nothing on record to show that any land exists in the name of the petitioner. Furthermore, brother and father of the petitioner are available in the family to do the agricultural work. It has also come on record that a case under the

Prisoners Act is pending against the petitioner.

No case is made out for grant of parole.

Accordingly, the petition stands dismissed.
