Present criminal revision has been preferred by the petitioner – Ranjit Singh against judgment dated 29.05.2012 passed by learned Additional Sessions Judge, Amritsar, whereby an appeal preferred by the petitioner has been dismissed and order dated 27.08.2010 on quantum of sentence passed by the learned Judicial Magistrate Ist Class, Amritsar has been modified as follows:-

Under Section 326 IPC

RI for 1-1/2 years with fine of Rs.1000/- and in default of fine, to further undergo RI for 10 days. Under Section 324 IPC

RI for 9 months with fine of Rs.250/- and in default

of fine, to further undergo RI for 5 days.

Under Section 323 IPC

RI for 3 months with fine of Rs.250/- and in default of fine, to further undergo RI for 5 days.

All the sentences were ordered to run concurrently.

I need not dilate upon the facts of this case in detail as

the same have already been recapitulated in the judgment of the learned Courts below and in view of the ultimate prayer of the petitioners seeking reduction in sentence.

I have heard the learned counsel for the parties and perused the record.

Learned counsel for the petitioner states that she is not pressing this revision on merit and is not challenging the conviction on merit. She is only aggrieved against the sentence part. Learned counsel for the petitioner states that petitioner is a first offender. However, she prays that the sentence of the petitioner be suitably reduced as this criminal trial is hanging on his head like Damocles' sword for the last more than eight years and it should be a sufficient mitigating circumstance to treat him leniently. Counsel for the petitioner has further submitted that the occurrence pertains to the year 2004 and since then a period of more than eight years has elapsed. The petitioner is a first offender and has suffered the ordeal for long period.

In view of the arguments advanced by learned counsel for the petitioner, which have been noted above, this Court is of the view that no useful purpose will be served to keep the petitioner behind the bars as the petitioner faced ordeal for 8 years. It is a fit case

wherein sentence awarded to the petitioner can be reduced to 9 months. Therefore, sentence is reduced from 1-1/2 years to 9 months. The impugned order of sentence stands modified accordingly.

With the observations made above, present revision petition is disposed of.
