During the course of preliminary hearing, a Coordinate Bench of this Court (Ram Chand Gupta, J.), passed the following order on 3.1.2012:-
“Contends that only allegation against petitioner is that there is violation of Clause 4 of the Fertilizer Control Order 1985 and that the fertilizer, allegedly recovered from the possession of the petitioner, was manufactured by a standard Company situated in the State of Gujarat and petitioner is also having licence for keeping the fertilizer. Further contends that only allegation is that fertilizer recovered was not entered in the stock register. Further contends that fertilizer and all the relevant documents have already been taken into possession by the police.
Notice of motion to Advocate General, Haryana for 24.01.2012.
However, petitioner is directed to join the investigation and in case he is arrested, he shall be released on interim bail by the Arresting Officer to his satisfaction subject to compliance of conditions specified under Section 438(2) Cr.PC.”
