The petitioner was arrested alongwith one Pakistani National, named, Kala Masih, who had infiltrated into this country by crossing the border. The petitioner alongwith this co-accused was arrested when he was found in possession of 2 kgs. of heroin. At that time, petitioner Baljit Singh was in possession of one pistol .30 bore and six live rounds of .30 bore. Another co-accused was also in possession of one pistol .30 bore and five live rounds of .30 bore. Even Kala Masih was found in possession of six pistols of .30 bore, 11 magazine of .30 bore, 150 live rounds of .30 bore.

Counsel submits that there was no recovery of heroin made from the petitioner. The petitioner is in custody since 11.5.2011, i.e., 1½ years. Challan was presented in October, 2011, but no witness has so far been examined. Referring to the reasons for which his bail was rejected by the Addl.Sessions Judge by observing that petitioner is responsible under Section 120-B IPC, counsel contends that the allegation of conspiracy even from the FIR is not made out.

This is a case which has International ramification. The petitioner has been found and arrested on the spot alongwith foreign national, who was in possession of Arms & Ammunition and this contraband and had illegally entered the country. The nexus of drugs dealers with terrorism or revival thereof is noticeable in this case and may have to be examined. In such a case, no consideration for bail, therefore, would be made out.

The petitioner has made this as a second attempt. His earlier application was got dismissed as withdrawn. Prayer for withdrawing the present petition is also made, which is declined. Dismissed.

There is no need to issue any direction for expediting the trial as is prayed for. This prayer is also declined.
