The earlier bail application was dismissed on 13.3.2012. When I was not inclined to grant bail in this case, counsel submits that this may be placed as per roster. I am not ready to accept this request. As per the law, this bail petition is required to be listed before this court since earlier order was passed on merits. There is no ground to release the petitioner on bail. Offence alleged against him is under Section 302 IPC. On the basis of evidence, the prosecution had earlier moved an application under Section 319 Cr.P.C. for summoning the additional accused. If some co-accused have been released on bail that will not impress me. The course of trial may get affected in case such persons are released on bail.
Dismissed.
