The present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.11, dated 15.1.2007, under Sections 379, 356 IPC, registered at Police Station Jaitu, District Faridkot.

I have heard learned counsel for the petitioner and have gone through the whole record carefully.

This is second application for anticipatory bail filed on behalf of the petitioner-accused. Her earlier bail application was dismissed on merit by coordinate Bench of this Court vide order dated 26.3.2012 passed in Crl.M.No.M-3303 of 2012.

Briefly stated, petitioner was already on bail. However, she absented from the Court and hence, her anticipatory bail was dismissed by

learned Additional Sessions Judge, Faridkot, on 12.5.2011. More than one year has expired. She has not surrendered before the trial Court. Thereafter, she filed anticipatory bail before this Court and this Court directed the petitioner to appear before learned trial Court and, however, despite that petitioner did not appear before learned trial Court and hence, her application for anticipatory bail was dismissed.

Hence, in view of these facts, and without expressing any opinion on the merits of the case, the present second petition filed by petitioner-Nathi for grant of anticipatory bail is, hereby, dismissed being devoid of any merit.
