The petitioner has approached this Court by way of present petition under Section 482 of the Code of Criminal Procedure invoking its inherent jurisdiction for direction to the official respondents to investigate the matter in FIR No.59 dated 11.3.2011 Sections 302, 120-B and 34 of the Indian Penal Code registered at Police Station Sadar Jalandhar in a fair and impartial manner.
Notice of motion was issued and pursuant thereto short reply by way of affidavit dated 14.10.2011 of Balkar Singh, Assistant Commissioner of Police, Jalandhar Cantt was filed. Status report by way of affidavit dated 24.7.2011 of Manpreet Singh, Assistant Commissioner of Police, Jalandhar Cantt has been filed in the Court today and the same is taken on record.

Learned counsel for the State, on instructions from HC Satnam Singh, Police Station City Jalandhar, submits that effective investigation was carried out and after conclusion thereof, report under Section 173 Cr.P.C. has already been presented to the learned court of competent jurisdiction on 22.6.2012. He further submits that one accused namely Lovely is still absconding and proceedings for getting him declared proclaimed offender have already been initiated. Another accused namely Amanat Masih was arrested on 24.3.2012.
Learned counsel for the State further submits that in view of the above-said developments having been taken place, the present petition does not survive and may be disposed of as infructuous.
Faced with the above situation, learned counsel for the petitioner fairly submits that in view of the reply and status report filed on behalf of the State and also keeping in view the statement made by the learned counsel for the State, the present petition has been rendered infructuous and may be disposed of as such
In view of the above statements made by the learned counsel for the parties, the present petition is ordered to be disposed of as having been rendered infructuous.
