The present petition under Section 438 Cr.P.C. for grant of anticipatory bail has been filed on behalf of petitioner, namely, Surinderpal Singh @ Shinderpal @ Shinda in case FIR No. 17 dated 17.4.2012 registered under Sections 307/427/506/148/149 IPC and Section 25 of Arms Act, 1959 at Police Station Bhadaur, District Barnala.
Learned counsel for the petitioner submits that co-accused of the petitioner have approached this Court by way of filing Crl. Misc. No. M- 15009 of 2012, wherein, notice of motion has been issued and their arrest have been stayed vide order dated 5.6.2012.
Heard.
After perusal of order of learned Additional Sessions Judge, Barnala, it came to the notice of the Court that the application moved by the petitioner was dismissed as withdrawn and subsequently the present

Crl. Misc. No. M-21848 of 2012 (O&M)
petition has been filed. Although learned counsel for the petitioner submits that petition of co-accused was also withdrawn but still their arrest has been stayed.
Since the petitioner has withdrawn his application before learned Additional Sessions Judge, Barnala and straightway has approached this Court by way of filing the present petition, learned counsel for the petitioner prays that he may be permitted to withdraw this petition.
Dismissed as withdrawn.
