The petitioner has approached this Court under Section 438 of the Code of Criminal Procedure (for short, 'Cr.P.C.') for grant of anticipatory bail in Complainant No. 20 dated 04.03.2009, under Sections 436, 427, 447, 506, 34 of the Indian Penal Code and Section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The learned counsel for the petitioner contends that in the FIR No.267 dated 01.12.2008, registered at the instance of the petitioner, the complainant herein has been convicted under Sections 447/506 IPC and sentenced to undergo rigorous imprisonment for a

period of three years.

This fact has not been disputed by the learned State

counsel.

In view of the above, without expressing any opinion on the merits of the case, the present petition is allowed. In the event of arrest of the petitioner by the Arresting Officer, he shall be released on interim bail subject to the following conditions:-

That he shall make himself available for interrogation by a police officer as and when required;

¶24

That he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer and;

That he shall not leave India without previous permission of the Court.

The petition stands disposed of accordingly.
