Present petition has been filed under Section 438 Cr.P.C. for the grant of pre-arrest bail to the petitioner in a case arising out of FIR No.36 dated 26.4.2011, registered at Police Station Mataur, District Mohali, under Section 498-A of the Indian Penal Code.

On 31.1.2012, statement of Abhishek Kumar petitioner and complainant aggrieved wife, Pallavi, were recorded by this Court. Counsel for the parties have jointly stated that the dispute has been amicably resolved and the petitioner and the complainant shall abide by the statements made by them before this Court on 31.1.2012. Statements so recorded separately on 31.1.2012 be read as a part of this order.

In terms of the statements, petitioner Abhishek Kumar has

handed over a draft of Rs.6.00 lacs drawn in the name of Pallvi, aggrieved wife. It is stated that parties have also signed joint petition which is to be filed under Section 13-B of the Hindu Marriage Act before Additional District Judge, Mohali.

In view of the amicable resolution of the dispute between the parties, Counsel for the State, on instructions from ASI Makhan Singh, has stated that the petitioner is not required by the investigating agency.

In view of the above, present petition is accepted and the order dated 21.6.2011 whereby interim bail was granted to the petitioner, is made absolute. It is ordered that in the event of arrest, the petitioner shall be released on bail to the satisfaction of the arresting officer till filing of the report under Section 173 Cr.P.C. Thereafter, the petitioner shall be permitted to file the regular bail bonds in the trial court. The petitioner shall continue to join the investigation as and when called. The petitioner shall also abide by the conditions specified under Section 438(2) Cr.P.C.
