The present petition has been filed under Section 438 Cr.P.C. for grant of pre-arrest bail to the petitioner in case arising out of FIR No. 328 dated 17.12.2010, registered at Police Station Shivaji Colony, Rohtak, District Rohtak, under Sections 376, 406 and 506 IPC.

On 17.10.2011, a Co-ordinate Bench of this Court had passed

“Petitioner seeks the concession of prearrest bail in a case registered at the instance of complainant-Jyoti alleging that the petitioner has made false promise of marriage to her and sexually exploited her.,

Counsel for the petitioner submits that the complainant and the petitioner are present in the Court and that they are happily married w.e.f. January 7, 2011.

The complainant is present in the Court to affirm the contention of counsel for the petitioner. Notice of motion for February 15, 2012. Meanwhile, an interim direction is issued that the petitioner will join investigation on November 19, 2011 and in case of his doing so, he will be released on interim bail to the satisfaction of the arresting officer.”

Today, complainant-Jyoti and petitioner-Pardeep Kumar are present in Court. They have been identified by Mr. Jasjit Singh Bedi, Advocate. Jyoti, who is present in Court, has stated that she has married Pardeep Singh and is living happily in her matrimonial home.

In view of the statement made by complainant-Jyoti, the present petition is accepted. Order dated 17.10.2011, passed by the Co-ordinate Bench of this Court, granting interim bail to the petitioner, is made absolute till filing of the report under Section 173 Cr.P.C. On submission of report under Section 173 Cr.P.C., the petitioner shall furnish regular bail-bonds to the satisfaction of the Court concerned. The trial Court shall be empowered to cancel bail of the petitioner in case of breach of any of the terms & conditions of the bail bonds.
