Sonam and Anr. Vs State of Haryana and Ors.

One Sonam and Sumer has approached this Court for protection of their life and liberty claiming that they are husband and wife and have married on having attained majority. Apprehending threat to their life and liberty at the hands of private respondents, this petition under Section 482 Cr.P.C. has been filed for a direction that their life and liberty should be protected.

Sunita has sought intervention by filing an application that as a matter of fact she is married to Sumer, petitioner No.2. She has relied upon an affidavit dated December 14, 2011 wherein Sumer Chand has affirmed on oath that he has married to Sunita on February 14, 2008.

Without entering into the controversy whether Sonam is wife of Sumer or Sumer is husband of Sunita, this petition is disposed of with a direction that irrespective of the status of Sonam and Sumer as husband and wife, they are entitled to protection of their life and liberty being citizens of India. A direction is issued that private respondents will not interfere in the individual life and liberty of petitioner No.1 or that of petitioner No.2. This order will not, in any manner, mean to an expression of any relief sought to protect petitioners No.1 and 2 as husband and wife. So far as rights of applicant Sunita are concerned, it will be open to her to claim her rights in case she is married to petitioner No.2 Sumer.
