The dispute is inter se the brother and sister. The property in dispute is in the name of their father, Late Shri Narinder Singh Bhatti. The complainant is the mother-in-law of the petitioner's brother, Mirgender Singh Bhati. The dispute regarding inheritance is going on between the parties. The petitioner apprehending threat to her life and liberty at the hands of her brother, Mirgender Singh Bhati, approached the Department of Home Affairs, Government of Rathasthan, to provide her security. In pursuance thereof, vide letter dated 29.11.2010, Annexure A-5, was written by the Additional Chief Secretary, Home Affairs Department, Government of Rajasthan, to the Inspector General of Police, Jodhpur Range, Jodhpur, she was provided security by observing that “It has been made out to me that Shri Mrigender Singh Bhati S/o Late Shri Narendra Singh Bhati has been threatening his mother and sister and is using violence in order to gain his ends and that there is a threat to the personal security of Smt. Radhika Datta”. The allegations against the petitioner are that she entered the house in question on 14.04.2012, ransacked the same, which is allegedly in the possession of Mirgender Singh Bhati, who on telephone, informed the complainant regarding the incident. The petitioner allegedly took away the belongings, documents pertaining to the properties, cash, etc.
