This petition has been filed under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail in case FIR No.37 dated 16.8.2011, under Sections 37,51.52-A,63,68-A of the Copy Right Act,1957 and Section 420/34 of the Indian Penal Code, 1860 at Police Station D Division, Amritsar(Annexure P1).

The following order was passed by this Court on 24.5.2012 :-

“Learned State counsel seeks to place on record affidavit of Harjinder Kumar Inspector/SHO Police Station D- Division, Amritsar City to contend that custodial interrogation of the petitioner is required. Affidavit is taken on record. This Court, however, feels that one opportunity needs to be granted to the petitioner to appear before the investigating officer and cooperate with the investigating agency.

Under the circumstances, petitioner is directed to join investigation forthwith. However, in the event of his arrest, the petitioner shall be released on bail to the satisfaction of arresting/investigating officer subject to the following conditions:-

i) He shall make himself available for interrogation by a police officer as and when required;

¶19

ii) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer, and

¶20

iii)He shall not leave India without the previous permission of the court.

In case the petitioner does not cooperate, the State counsel shall be at liberty to apprise this court on the next date of hearing.

To come up on 23.7.2012.”

Learned State counsel, on instructions from Sub Inspector Kulbir Singh, has submitted that the petitioner has joined investigation in terms of the order reproduced above.

Accordingly, the interim bail granted to the petitioner by this Court vide order 24.5.2012 is made absolute.

Petition stands disposed of accordingly.
