Zuari Cements Limited and Ors. Vs Vardhman Yarns and Threads Limited

Prayer in the present petition under Section 482 Cr.P.C. is for quashing of criminal case bearing No.23/1 of 24.01.2008, titled as 'Vardhman Yarns & Threads Limited versus Zuari Cements Limited', pending in the Court of learned Judicial Magistrate First Class, Ludhiana, and all subsequent proceedings flowing therefrom, including the summoning order dated 10.12.2011, Annexure P-2.

The learned counsel, inter alia contends that the impugned order, Annexure P-2, has been passed without jurisdiction as the petitioners are operating beyond the territorial jurisdiction of the learned Court.

On the other hand, the learned counsel for the respondent submits that the present petition is not maintainable as the petitioners have the alternate efficacious remedy of revision before the Sessions Court.

In the facts and circumstances of the case, this Court finds favour with the contention raised by learned counsel for the respondent. The petitioners have the alternate efficacious remedy of filing a revision petition before the learned Sessions Judge, for the relief sought in the present petition.

In view of the above, the present petition is dismissed with liberty to the petitioners to avail the remedies available to them as per law.
