Petitioner-Jagjit Singh son of L. Sh. Gurnam Singh, has directed this application for regular bail in a case registered against him along with other main accused Jagtar Singh and others vide FIR No.41 dated 12.05.2008, on accusation of having committed offence punishable under Sections 302, 307, 323, 324, 325,

148, 149, 452 and 506 IPC by the police of Police Station Lohian, District Jalandhar.

Notice of the application was issued to the State.

After hearing the learned counsel for the parties, going through the record with their valuable assistance and after considering the entire matter deeply, to my mind, the instant petition deserves to be accepted in this context.

According to the prosecution Jagtar Singh son of Santa Singh, main accused gave a fatal gandasi blow on the head of Phuman Singh, culminating into his death. No injury is attributed to the petitioner having been caused to the deceased. The prosecution claimed that petitioner Jagjit Singh only gave a lathi blow which hit on the little finger of right hand of the complainant-Harbans Singh. No other specific role or overt-act is attributed to the petitioner. It is not matter of dispute that petitioner was arrested on 19.12.2011 and since then he is in custody. No useful purpose would be served in further detaining him in jail.

In the light of aforesaid reasons, taking into consideration the role attributed to the petitioner, totality of facts and circumstances emanating from the record as discussed here-in-above and without commenting further anything on merits, lest it may prejudice the case of either side during the course of trial of main case, the instant application for regular bail filed by the petitioner is hereby accepted. Petitioner is ordered to be released on bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court.
