This is a petition filed under Section 438 Cr.P.C. for grant of concession of anticipatory bail to the petitioners in case FIR No.6 dated 11.2.2012 under Sections 420/406 IPC and Section 24 of the Immigration Act, registered at Police Station Dhilwan, District Kapurthala.
Heard learned counsel for the parties.
This court, while issuing notice of motion on 12.4.2012 directed that in the event of arrest, petitioners would be released on interim bail to the satisfaction of the arresting officer/investigating officer in connection with abovesaid case FIR.
On instructions from Assistant Sub Inspector Malkeet Singh, learned State counsel informs that petitioners have joined the investigation, however, recovery has not been effected.
Prosecution has failed to show to this Court from which source the amount has come.
Having considered the facts and circumstances of the case, the order dated 12.4.2012 passed by this Court is made absolute.
Petition disposed of accordingly.
