Brief facts as culled out from the record of the case are, that on 18.06.1998 ASI Jaswant Singh along with other police officials was going from village Nurpur Hakima towards heads canals Nurpur Hakima. When the police party reached near bridge of head canal, accused was seen coming from Village Karyal carrying a gunny bag on his head. The accused seeing the police party suddenly turned towards his hand and went towards vacant land adjoining canal bank and sat there. On the basis of suspicion, ASI Jaswant Singh apprehended the accused. In the meantime, Mehal Singh came there and he was also joined the police party. On the consent of the accused for search before ASI Jaswant Singh, search of the gunny bag was conducted and it was found containing 25 kgs. poppy husk. Out of which sample of 250 grams was separated and remaining poppy husk weighing 24 kgs 750 grams was put in the same bag. The samples and the bag were converted into parcels and sealed with the seal. Sample seal Ex.P1 was separately prepared and seal after use was handed over to HC Ved Parkash. Case property was taken into possession vide recovery memo Ex.P3. Thereafter, ruqa Ex.P5 was sent to the police station, on the basis of which, formal FIR (Ex.P6) was registered. The Investigating Officer prepared the rough site plan (Ex.P7) and on return to the police station, he produced the accused, sample seal and the case property before SHO Balbir Singh, who produced the case property in the Court of Illaqa Magistrate.
