Present : Mr. Rajesh Lamba, Advocate for the petitioners.
L. N. MITTAL, J. (Oral) :
Counsel for the petitioners states that under the garb of impugned order (Annexure P-1) passed by the trial court, defendantrespondent no.1 wants to take possession of 150 sq. feet area on the front side, although she is in possession of 150 sq. feet area on the back side, which includes room and some open space. However, no such controversy has been raised before or adjudicated upon by the trial court in the impugned order. Consequently, this contention cannot be raised for the first time for getting adjudicated upon in this revision petition.
Faced with the aforesaid situation, learned counsel for the petitioner seeks permission to withdraw the instant revision petition, with liberty to file appropriate application in the trial court for appropriate relief in accordance with law.
Dismissed as withdrawn, with liberty as aforesaid.
