Challenge in the present petition is to the order dated 21.1.2012, passed by the learned court below, whereby the objections filed by the petitioner in execution of an ex-parte decree dated 23.11.2010, have been dismissed along with the application filed by him for setting aside of ex-parte decree.
Learned counsel for the petitioner submitted that the petitioner has already challenged the order dismissing the application for setting aside of ex-parte decree by filing an appeal before the lower appellate court. He seeks permission to withdraw the present petition to pursue his appeal.
Ordered accordingly.
