Learned counsel for the appellants has placed on record compromise-cum-settlement deed dated 29.9.2010. Challenge was to the sale deed Ex. D-1 dated 13.1.1994 to the extent of 700 square feet in a suit for possession of the house bearing No. M.C. No. B- XVII-1591/1 Basti Abdullapur, Ludhiana. Vide judgment dated 5.12.2003 the suit was decreed by Shri Ravinder Kumar Condal, the then Civil Judge (Jr. Divn.) Ludhiana. An appeal was preferred by the Appellate Court which was dismissed by the Court of Shri J.S. Bhatia, the then Additional District Judge, Ludhiana vide order dated 26.7.2004. Thereafter, the present Regular Second Appeal was filed and the same was stand admitted on 28.1.2005. During the pendency of this appeal compromise has been effected which is

being annexed alongwith Civil Misc. Application as Annexure A-1. The respondents have entered into compromise and has received lump sum from the plaintiff towards full and final settlement and has agreed that he and his legal heirs will not claim any share in the property in dispute. Affidavit of Daljit Singh s/o Sohan Singh who is General Power of Attorney has been filed alongwith the compromise deed. Copy of the General Power of Attorney has been annexed with this affidavit.
Learned counsel for the respondents states that the compromise has been duly effected between the parties.
The appeal is disposed of in view of compromise-cumsettlement deed dated 29.9.2010.
