Learned counsel for the appellant has in fact questioned the findings of the Inquiry Officer. It is stated that no witness was examined during the inquiry except tendering the judgement of the M.A.C.T. However, from the writ petition, filed before the learned Single Judge, we find that the inquiry has not been challenged by the appellant herein.
In this view of the matter, learned counsel for the appellant seeks to withdraw the writ petition with liberty to file a fresh one challenging the inquiry as well.
Prayer allowed.
C.W.P. No. 4361 of 2011 filed by the appellant is hereby dismissed as withdrawn with the liberty as prayed for. Consequently, the present appeal is rendered infructuous.
Dismissed as such.
