Challenge in the present appeal is to the order passed by the Commissioner under the Employees Compensation Act, 1923 (for short “the Commissioner), awarding the compensation to respondents No.1 and 2 on account of death of Jaswant Rai @ Jaswant Singh. The claimants were the parents.
The deceased was employed with the appellant as Godown Attendant-cum-Chawkidar. The Commissioner assessed the compensation payable to the claimants at ` 64,584/-. Jaswant Rai died on account of consumption of Aluminium Phosphide.
A perusal of the file shows that on January 12, 2009, actual date notices were directed to be issued for service of respondents No.1 and 2-claimants, the parents of the deceased. Office report shows that the notices issued to them were received back with the report that both have expired. Considering the factual position without opining on the merits of the controversy as such, however, considering that now it may not be possible to recover the amount of compensation from the persons who have already expired, no further orders are required in the present appeal.
Dismissed.
