The petitioner seeks quashing of the order dated 23.01.2009 [Annexure P-14] passed by the Amritsar Improvement Trust, Amritsar, whereby No Objection Certificate seeking exemption from acquisition of his property, has been declined.
Learned counsel for the parties are ad-idem that similar controversy came up for consideration before this Court in Harcharan Singh Bhatti v State of Punjab & Anr., CWP No. 6646 of 2009, decided on 25.02.2010 and Swaran Kaur v State of Punjab & Ors., CWP NO. 6916 of 2009, decided on 08.10.2010 [Annexures P-17 and P-18] and the same was decided in favour of the owners like the petitioner.
For the reasons assigned by this Court in Harcharan Singh Bhatti and Swaran Kaur's cases [supra] , the writ petition is allowed in the same terms.
