(1). The petitioner is widow of Santokh s/o Shiv Dass, who was a Safai Sewak and unfortunately passed away on 27.02.2010 while in service. The non-payment of the retiral and terminal service benefits has compelled the petitioner to approach this Court.

(2). On 07.03.2011 respondents No.2 to 4 were directed to release the family pension, ex gratia , GPF and other retiral benefits to the petitioner along with interest @ 9% per annum from the date of the unfortunate death of her husband.

(3). The Executive Officer, Municipal Council, Batala has filed a short-affidavit today stating that the above-stated order has been complied with.

(4). Learned State counsel, on instructions from an official (Jaspal Singh) states that the ‘family pension’ has also been released in favour of the petitioner.

(5). Learned counsel for the petitioner points out that the arrears of ‘family pension’ from the due date are yet to be paid.

(6). Learned counsel for the Municipality states that the benefit of revised pay scale and the consequential pensionary and other service benefits shall be granted to the petitioner in terms of slab laid down in the Government instructions, as early as possible but not later than three months.

The writ petition is accordingly disposed of with a direction to respondents No.2&3 to ensure the payment of arrears of pension with effect from the date of death of the petitioner’s husband within a period of two months from the date of receipt of a certified copy of this order, if already not paid.

(8). Similarly, the benefit of revised pay scales shall also be granted by respondents No.2 to 4 in terms of the directions/ undertaking given above.
