The prayer of the petitioner in the present petition is for issuance of a writ in the nature of mandamus directing the respondents to release the pension and pensionary benefits to the petitioner admissible under the rules as the petitioner has been retired from the services on 31.07.2010 and till date, the pension and pensionary benefits have not been released to him, whereas, there is no pending inquiry against him.

Contends that the petitioner had retired from the services on 31.07.2010 on attaining the age of superannuation. His pension and pensionary benefits have not been released to him till date. As the respondents even after a lapse of more than one year are sitting over the representation, a legal notice was sent on 08.08.2011 (Annexure P-3). However, the same has not been decided till date. It is further stated that the documents Annexures P-4, P-5 and P-6 are applicable to the petitioner

In view of the above, the present petition is disposed of, at this stage, with a direction to the respondents to decide the legal notice dated 08.08.2011 (Annexure P-3), as expeditiously as possible, preferably within two months from the receipt of a copy of this order.

However, in case, the petitioner is found entitled for the said relief, the same shall be released forthwith. In case, the claim of the petitioner is to be rejected, the same shall be by passing a speaking order.
