The petitioner prays for issuance of a writ in the nature of mandamus directing respondent no.2 to sanction the building plan submitted by the petitioner in November, 2008 and to comply with order dated 11.12.2008, passed by the Administrator, HUDA, Gurgaon.
Mr. Arun Walia, counsel for the Estate Officer-I, HUDA, Gurgaon, respondent no.2, submits that he has received an e-mail communication dated 12.10.2011, to the effect that the Chief Administrator, HUDA, has directed the Estate Officer-I, HUDA, Gurgaon, to implement order dated 11.12.2008, passed by the

Administrator, HUDA and sanction the building plan, subject to any writ petition/SLP that may be filed by the HUDA. A copy of the e-mail communication duly attested by Mr. Arun Walia, Advocate, is taken on record as Mark-'A'.
In view of the statement made by Mr. Arun Walia, Advocate, based upon the e-mail communication at Mark-'A', the writ petition has been rendered infructuous and is disposed of accordingly. The Estate Officer-I, HUDA, Gurgaon, is directed to do the needful within a week from the receipt of a certified copy of this order. No order as to costs.
