Mohan Singh Vs Sub Divisional Canal Officer and Ors.

The petitioner seeks quashing of the orders dated 8.7.2009 (Annexure P-3), 24.8.2009 (Annexure P-4) and 17.9.2009 (Annexure P-6) passed by respondent Nos.1 to 3, respectively.

Learned counsel for the private respondents points out at the outset that during the pendency of this writ petition, the dismantled outlet was restored on their request and thereafter a new water channel has been sanctioned on that very place. This has resulted into rendering this writ petition as infructuous. Learned counsel for the petitioner, on the other hand, points out that meanwhile, a pacca road has been laid with pipes

underneath for irrigation which will be convenient for both the parties. If that is so, the petitioner is at liberty to approach the Canal Authorities against the sanctioning of water channel in favour of the private respondents. In case the petitioner files such a petition/appeal within a period of one month from the date of receiving a certified copy of this order, the same shall not be dismissed as time barred and shall be decided on merits in accordance with law.
