Subhash Chander Vs Registrar Coop. Societies, Pb. and Ors.

This writ petition has been filed challenging the order dated 24.8.2010 (Annexure P-4) vide which warrants of arrest have been issued against the petitioner by the Assistant Registrar, Cooperative Societies, Balachaur.

During the course of hearing, counsel for the petitioner has stated that in compliance of the order passed by this Court on 25.4.2011, petitioner has already appeared before respondent No.2-Assistant Registrar, Cooperative Societies, Balachaur. He undertakes to continue appearing before him as and when required. This statement made by the counsel for the petitioner is acceptable to the counsel for the respondent-State.

Without going into the merits of the assertion made by the petitioner with regard to the competence or authority of the Assistant Registrar, Cooperative Societies to issue a warrant of arrest under Section 83 of the Punjab State Cooperative Societies Act, 1961 and Section 32 of

the Code of Civil Procedure, 1908, the present writ petition is disposed of. The petitioner shall be bound by the statement made by his counsel in Court.

In the light of the statement made above, the warrants of arrest issued against the petitioner vide order dated 24.8.2010 shall not be given effect to.
